Terms of Service

These Terms of Service ("Terms") constitute a binding enterprise software agreement between myPeshkar Technologies ("Provider", "we", "us", or "our") and the subscribing advocate, senior counsel, chamber administrator, or law firm entity ("Subscriber", "Chamber", or "you") governing access to the myPeshkar autonomous legal operating system ("Platform").

By provisioning a chamber workspace, authenticating an API token, or adding court matter credentials, the Subscriber acknowledges having read, understood, and consented to these Terms. If acting on behalf of a partnership firm or boutique chamber, the individual warrants holding the requisite authorization to bind the entity.

The Platform functions as a digital court peshkar—an autonomous Software-as-a-Service (SaaS) utility providing court registry synchronization, 16-digit CNR tracking, encrypted Vakalatnama/brief storage, AI order text parsing, and cause list email dispatches.

We recognize that attorney-client communication is protected under Section 126 of the Indian Evidence Act and professional conduct rules. The Provider operates under a strict non-disclosure, zero-access technical architecture:

• AES-256-GCM Vault Isolation: All uploaded petitions, affidavits, interim orders, and fee ledgers are encrypted at rest with chamber-specific keys.
• No Commercial Mining: We do not inspect, aggregate, sell, or commercialize confidential legal strategies, litigant identities, or docket files.
• Zero Conflict of Interest: The Provider does not represent litigants or operate a competitive legal advisory firm.

The Platform utilizes automated background sync daemons to poll public court registries across District Courts, High Courts, the Supreme Court, and specialized tribunals (NCLT, DRT, NGT).

While background workers employ high-frequency sweeps to retrieve revised business dates and certified order PDFs, public registry availability remains subject to government server uptime. Counsels remain ultimately responsible for verifying statutory limitation periods under the Limitation Act for filing appeals, revisions, and caveats.

Subscribers are granted configurable role hierarchies (Managing Partners, Arguing Counsels, Associate Advocates, Chamber Clerks). The Chamber Administrator bears full responsibility for:

• Provisioning and revoking user credentials for junior advocates and back-office staff.
• Auditing the 3-Tier Staging Queue before sealing associate drafts into the master docket.
• Safeguarding workspace credentials and multi-factor authentication vectors.

The Subscriber covenants that they shall not, directly or indirectly:

• Reverse engineer, decompile, or extract the underlying source code of the Platform.
• Circumvent multi-tenant isolation boundaries or attempt unauthorized schema traversal.
• Upload malicious payloads, viruses, or automated scraping scripts against Platform endpoints.
• Use the platform in violation of applicable data privacy laws, including the Digital Personal Data Protection Act (DPDPA).

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by Indian law, the Provider disclaims all implied warranties of merchantability and fitness for a particular judicial outcome.

In no event shall the Provider be liable for any indirect, consequential, or punitive damages (including loss of professional fees, litigation outcomes, or missed court listings resulting from government registry downtime or user oversight).

Either party may terminate the workspace subscription at the conclusion of a billing cycle. Upon account closure, the Chamber is provided a 30-day export window to download all case records, order copies, and client ledgers in standard formats.

Following the 30-day portability window, all encrypted tenant blobs undergo permanent cryptographic deletion in accordance with our zero-retention schedule.

These Terms shall be governed exclusively by and construed in accordance with the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of competent courts located in Kolkata, West Bengal, India.
